Construction guarantees in France
French law protects the client from acceptance of the works.
Completion guarantee – 1 year
Civil Code art. 1792-6: the builder repairs all defects noted at acceptance or during the following year.
Two-year guarantee
Art. 1792-3: covers equipment separable from the structure, such as radiators or taps.
Ten-year guarantee (décennale)
Art. 1792: for 10 years from acceptance, the builder is liable for damage that compromises the structure’s soundness or makes it unfit for use.
Dommages-ouvrage insurance
It is mandatory for the client and pays out quickly without waiting for liability to be decided. Failing to hold compulsory insurance carries up to 6 months’ imprisonment and/or a €75,000 fine.
